GOOD NEWS! The porn industry lost their court appeal regarding condom use, and the L.A. County law will be upheld. 🙂

Making adult-film performers wear condoms during porn production does not violate freedom of expression but instead protects public health and workers on set, a federal appeals court concluded Monday morning.

The 30-page ruling largely discounted what had long been an argument by the adult-film industry: That Measure B, a voter-approved law that requires condoms be used on all porn shoots in Los Angeles County, compromises an actor’s artistic expression and ruins the fantasy aspect of pornography.

Yay team! 🙂 Read more details in the article below:

Another important development along these lines is the latest report from the California Department of Public Health:

Occupational HIV Transmission in the Adult Entertainment Film Industry

What should be done in light of this investigation?

    • Correct and consistent use of condoms is known to reduce the risk of HIV and other sexually transmitted diseases. Adult entertainment film actors should use condoms, and film producers should require on-set condom use by actors. The California Division of Occupational Safety and Health (Cal/OSHA) has determined that employers are required to furnish and ensure the use of condoms in the production of adult films at no cost to the actors.

Yay!

The porn industry still won’t protect the health and safety of performers, so ex performers and the AIDS Healthcare Foundation have protested recently in Los Angeles and Oakland and held a press conference in L.A.

Their goals are to get Cal/OSHA to clarify their standards regarding condom use in porn, and to get condoms in porn legislation for California added to the 2016 Presidential election ballot. Protesters include our good friend Cameron:

“…The bureaucratic process means that more performers will be at risk of contracting sexually transmitted diseases on film sites, said Cameron Adams, who went by the name Cameron Bay when she was a performer. Adams said she contracted HIV last year while shooting at San Francisco-based Kink Studios.

“I’m fighting for the rights and health of performers out there so they don’t end up like me, and this is the only way we’re going to get to them,” said Adams. She met with Cal/OSHA officials during the protest to hand them a letter asking they release their standards immediately.”

YAY! The bill to mandate condoms in porn and more STD testing has moved forward one more step in the California Senate.

[Herald Online] — California Assembly Bill 1576, a landmark bill that clarifies and strengthens state worker safety laws requiring condoms in all adult films made statewide in California, cleared the state Senate Labor and Industrial Relations Committee earlier today in a 3 to 1 to 1 vote and will now move on to the Senate Appropriations Committee. Assemblymember Isadore Hall, III (D-Los Angeles) from California’s 64th Assembly District, authored the bill, which he introduced in mid-February.

Senate Labor Committee members Ben Hueso (D, San Diego, 40th District, Chair), Holly Mitchell (D, Los Angeles, 26th District) and Alex Padilla (D, Pacoima, 20th District) voted in support of the bill with Mark Leno (D, San Francisco, 11th District) voting against the bill, and Mark Wyland (R, Carlsbad, 38th District, Vice Chair) abstaining.

“Today, the Members of the Senate Labor & Industrial Relations Committee overwhelmingly saw beyond the adult film industry’s flaccid misinformation campaign and took decisive action to protect these actors in the workplace,” said Assemblymember Isadore Hall, III in a statement. “I want to thank the many actors that testified in support of AB 1576, especially Ms. Sofia Delgado, who courageously came forward today to announce that she was the third of five adult film actors to have contracted HIV in 2013. She, along with former actors Cameron Bay, Rod Daily and others have shown an incredible amount of character to be able to share their very personal challenges in hopes of saving the lives of others.”

On Wednesday a landmark vote in the California senate could specifically require condoms for all porn shot in California.

The porn industry is already legally required per CAL OSHA general health and safety standards to provide protection from blood borne pathogens and potential sexually transmitted diseases, but this bill, AB 1576, would specifically address the porn industry.

Despite a recent UCLA study showing how much higher the STD rates are in the porn industry than the general population (see: http://www.aidshealth.org/wp-content/uploads/2013/06/Adult-film-poster-STD-Prevention-2014.pdf), the porn industry is fighting this bill in a really big way, including with expensive lobbyists they’ve hired. They don’t want anything cutting into their profits gained by exploiting their workers. (Many of whom are young and uninformed, and often survivors of sexual abuse.)

READ THE FULL ARTICLE ABOUT THE UPCOMING VOTE:

http://www.edgeonthenet.com/news/aids/News/161031/%E2%80%99condoms_in_porn%E2%80%99_vote_looms_in_ca_state_senate

To elaborate, technically barrier protection from blood-borne pathogens and STDs is already required countrywide in all workplaces by OSHA standards. However, because the porn industry likes to avoid any such regulation, they have not been complying with these standards.

So Measure B, to specifically require condom use in porn, was passed in Los Angeles *city* first of all, then Los Angeles *county.* So it is now specifically required that condoms be used in porn films in those areas. This has resulted in more filming taking place outside of those areas, such as Ventura County and San Francisco, etc. But many, if not most, just continue to shoot in Los Angeles County, but don’t get the film permits they are supposed to, and still don’t use condoms.

Regarding the entire state of California, CAL OSHA standards still currently apply, but aren’t yet being fully carried out or enforced, which is the motivation behind getting the bill similar to Measure B, called AB 1576, passed for all of California. This is the bill that is going up for a vote this Wednesday in the California Senate.

The porn industry has continually threatened to move out of state if condoms are specifically required state-wide, and if this law is regularly enforced. However, many see this as an empty threat, because technically pornography is only legal to film and California and New Hampshire, and the likelihood of them setting up in New Hampshire is very slim.

Currently some filming does illegally take place in Nevada and Florida, and some other states, but the Aids Healthcare Foundation has made it clear that should the industry decide to actually start filming in great quantity in Nevada, Florida or elsewhere, that they will get similar legislation as Measure B and AB 1576 passed in those other states.

Since this is a bit of a complicated issue, here are two other articles which give a few more details which might be helpful:

We will update you Wednesday or Thursday as to what happened. Hopefully we’ll have good news that the porn industry will be held to the same standards as every other industry, and will have to protect their workers!

YAY! The bill to expressly require condoms in porn in ALL OF CALIFORNIA passed the CA appropriations committee! ~~ 🙂

This means the members of the committee value the health and safety of the performers as HUMAN BEINGS, over the PROFITS of the porn industry. (The porn industry’s main objection to AB 1576 is how it will affect their profits.)

It took THREE tries over the past few years, but thanks to the hard work and persistence of the AIDS Healthcare Foundation and Isadore Hall Isadore Hall, the goal of passing this step was finally accomplished. Now only two more steps to go before the bill is law: 1) the assembly floor, and 2) the Senate. Read the details below…

JUSTICE! 🙂 Torture porn company Kink(dot)com can’t get away with abusing performers with unsafe sex anymore!

[SF Weekly] – On Thursday, the California Occupational Safety and Health Administration issued a whopping $78,710 fine to local porn company Kink.com for workplace safety hazards. The majority of the fines were for allowing performers to work without using condoms, while a $3,710 portion of the total fine was for additional violations, including improperly placed power cords, an absence of first aid supplies, and missing health safety training materials.

The fine is one of several that OSHA has issued to local porn companies recently, and follows in the wake of several HIV scares in the industry.

And there are more fines to come! Read full details in the link below, and at the other links below that. 🙂

Check out the details below!

[L.A. Weekly] Condoms are mandatory for porn production in California, an administrative law judge has ruled.

The AIDS Healthcare Foundation, which has been fighting for laws that explicitly require prophylactic use in adult film, last night called the ruling by a California Division of Occupational Safety and Health (Cal/OSHA) judge a “landmark decision” that affirms “barrier protection” applies specifically to the porn business.

AHF spokesman Ged Kenslea told us that one of the most important aspects of the ruling is its affirmation that performers are indeed employees due protection under under workplace safety rules. The group has long argued that federal law prohibiting exposure to bloodborne pathogens such as sperm at the workplace applies to California’s adult performers.

The industry has said that porn stars are very part-time workers who paid per “scene” as independent contractors.

The ruling by Judge Mary Droyovage wrote that, without condoms, there is “substantial probability that employees would suffer serious exposure resulting in serious physical harm or death if violation occurred.”

Please click on the triangle “play” icon in the middle of the picture below to hear why Jersey recently quit porn, how harmful to one’s health the porn industry can be, and how dehumanizing and degrading the industry is.

Part 2:

As you can hear in the interview, another former porn star, Shelley Lubben, is kindly working very hard to help Jersey. Below is an excerpt of what Shelley writes about Jersey on her website. Following that is an excerpt of their interview.

*********************************************************

“I met Jersey Jaxin about two months ago through Myspace and she allowed me to come and spend time with her and listen to her story. She spoke about many things from her sexual abuse from her father to the abuse she went through in the porn.

Much of her life can be summed up in one word: ABUSE.

She made me cry during our meeting quite a bit but especially when I asked her what she did in her off time when she wasn’t doing porn and she replied, “I hold my roommate and we just cry”.

RussellsParadox, a visitor to our AntiPornographyBlog YouTube channel, asked the above question. The space to reply at YouTube was limited, so we are posting the full response here. The simple version of it is as follows:

1) If you are referring to the United States, regardless of what anyone think, most pornography is actually technically already illegal. It just isn’t prosecuted.

2) We believe that there are legal measures that can and should be put into place that can significantly reduce the harm done to individuals during the production of pornography. (And as a result of what happened during that production.) These measures can also reduce the harm done to women, children, and society in general from the existence of, consumption of, and influence of violent, degrading, and sexist pornography. Such measures would include: restricting access of Internet pornography and other types of pornography to those who are 18 and over, raising the age of participation in pornography to 21 years old, and improving the health and safety standards of pornography production in a variety of ways, including implementing mandatory condom use.

So that’s the short answer. For a longer and more detailed response with references included, please continue reading. (But be forewarned: there is very graphic, disturbing, and likely triggering content ahead!) (more…)

Some of you may not be aware that there are some individuals within the pornography industry itself who are speaking up directly about the harms of the pornography, and who are advocating for positive reform. For instance, besides writing her book that exposes the harsh realities of the industry, “How To Make Love Like A Porn Star, A Cautionary Tale, Jenna Jameson has openly advocated for raising the age of participation in pornography to twenty-one:

“I have major misgivings about talking to girls who are eighteen or nineteen years old about signing a contract. At eighteen years old it’s hard to make a life choice. I truly believe there should be an age verification at twenty-one years old for this industry.” (Full interview with PR.com here.)

Another performer, Devyn Devine, who is a newcomer and not as well known, (and who is also a sociology student), wrote an article for Adult Industry News, (AINews (dot) com), called Does Porn Dehumanize. In it Devyn writes:

“There is a correlation between mass media and violence. Using my last column as a springboard, if mainstream is doing it, then the porn industry takes it to the next level.”

“Think about it. We see nudity in mainstream movies, but see full-fledged, over exaggerated (Really, honey, do the implants NEED to be that big?) full frontals in porn. We see simulated sex in mainstream, and we see full on, get down and dirty, give it to me baby harder and harder sex in porn. Now we see ads that promote female violence and portray us like we are nothing more then a piece of trash to be walked on. What desensitizes us to things is the recurring image and message over and over again.” (more…)
