It’s good to see that porn actor “Mr. Marcus,” who knowingly exposed others to syphilis, has to pay one of his victims a significant amount of damages! It’s some measure of justice, anyway. Hopefully others will note these harsh consequences, and NEVER consider misleading their employers or fellow workers about their STD status and test results!

[Post Periodical] – Los Angeles Superior Court Judge David Minning heard testimony Friday from Heather DeAngelo, known in the industry as Lylith LaVey, before ordering Jesse Spencer to pay her $129,360. Spencer did not participate in the court proceedings and was found to be in default.

DeAngelo sued Spencer, also known as Mr. Marcus, in September 2012 after finding out he had the communicable disease, according to her complaint alleging fraud, negligence, battery, intentional infliction of emotional distress. The scenes involving DeAngelo and Spencer were filmed in July 2012 in Encino, according to court records.

DeAngelo did not allege she contracted the disease.

———-

In addition to this latest penalty…

“Last year, Spencer was sentenced to 30 days in jail and three years probation for “knowingly exposing at least two co-stars to syphilis after testing positive for the disease days earlier.”

YAY! The bill to mandate condoms in porn and more STD testing has moved forward one more step in the California Senate.

[Herald Online] — California Assembly Bill 1576, a landmark bill that clarifies and strengthens state worker safety laws requiring condoms in all adult films made statewide in California, cleared the state Senate Labor and Industrial Relations Committee earlier today in a 3 to 1 to 1 vote and will now move on to the Senate Appropriations Committee. Assemblymember Isadore Hall, III (D-Los Angeles) from California’s 64th Assembly District, authored the bill, which he introduced in mid-February.

Senate Labor Committee members Ben Hueso (D, San Diego, 40th District, Chair), Holly Mitchell (D, Los Angeles, 26th District) and Alex Padilla (D, Pacoima, 20th District) voted in support of the bill with Mark Leno (D, San Francisco, 11th District) voting against the bill, and Mark Wyland (R, Carlsbad, 38th District, Vice Chair) abstaining.

“Today, the Members of the Senate Labor & Industrial Relations Committee overwhelmingly saw beyond the adult film industry’s flaccid misinformation campaign and took decisive action to protect these actors in the workplace,” said Assemblymember Isadore Hall, III in a statement. “I want to thank the many actors that testified in support of AB 1576, especially Ms. Sofia Delgado, who courageously came forward today to announce that she was the third of five adult film actors to have contracted HIV in 2013. She, along with former actors Cameron Bay, Rod Daily and others have shown an incredible amount of character to be able to share their very personal challenges in hopes of saving the lives of others.”

Check out the rest of the story below… Unsurprisingly, the porn industry is outraged that anyone dare to try and get them respect basic health and safety standards.

On Wednesday a landmark vote in the California senate could specifically require condoms for all porn shot in California.

The porn industry is already legally required per CAL OSHA general health and safety standards to provide protection from blood borne pathogens and potential sexually transmitted diseases, but this bill, AB 1576, would specifically address the porn industry.

Despite a recent UCLA study showing how much higher the STD rates are in the porn industry than the general population (see: http://www.aidshealth.org/wp-content/uploads/2013/06/Adult-film-poster-STD-Prevention-2014.pdf), the porn industry is fighting this bill in a really big way, including with expensive lobbyists they’ve hired. They don’t want anything cutting into their profits gained by exploiting their workers. (Many of whom are young and uninformed, and often survivors of sexual abuse.)

READ THE FULL ARTICLE ABOUT THE UPCOMING VOTE:

http://www.edgeonthenet.com/news/aids/News/161031/%E2%80%99condoms_in_porn%E2%80%99_vote_looms_in_ca_state_senate

To elaborate, technically barrier protection from blood-borne pathogens and STDs is already required countrywide in all workplaces by OSHA standards. However, because the porn industry likes to avoid any such regulation, they have not been complying with these standards.

So Measure B, to specifically require condom use in porn, was passed in Los Angeles *city* first of all, then Los Angeles *county.* So it is now specifically required that condoms be used in porn films in those areas. This has resulted in more filming taking place outside of those areas, such as Ventura County and San Francisco, etc. But many, if not most, just continue to shoot in Los Angeles County, but don’t get the film permits they are supposed to, and still don’t use condoms.

Regarding the entire state of California, CAL OSHA standards still currently apply, but aren’t yet being fully carried out or enforced, which is the motivation behind getting the bill similar to Measure B, called AB 1576, passed for all of California. This is the bill that is going up for a vote this Wednesday in the California Senate.

The porn industry has continually threatened to move out of state if condoms are specifically required state-wide, and if this law is regularly enforced. However, many see this as an empty threat, because technically pornography is only legal to film and California and New Hampshire, and the likelihood of them setting up in New Hampshire is very slim.

Currently some filming does illegally take place in Nevada and Florida, and some other states, but the Aids Healthcare Foundation has made it clear that should the industry decide to actually start filming in great quantity in Nevada, Florida or elsewhere, that they will get similar legislation as Measure B and AB 1576 passed in those other states.

Since this is a bit of a complicated issue, here are two other articles which give a few more details which might be helpful:

http://www.aidshealth.org/archives/18153

We will update you Wednesday or Thursday as to what happened. Hopefully we’ll have good news that the porn industry will be held to the same standards as every other industry, and will have to protect their workers!

NEW HARM STORY! Ex porn performer Jessie Rogers shares how she got into porn, how harmful it was and why she left! ~~~~~~~~~~~~

JESSIE’S STORY:

I got into porn the day after my 18th birthday. Here’s how it happened…

A week before I turned 18, I was just scanning around the “jobs” section on Craigslist, not even looking for porn. I found an ad in the TV/film/video section that said “MAKE $20,000 – $30,000 A MONTH MODELING.” In the description it said nothing about porn or video work, they simply asked people to e-mail them a photo. Once I sent the agency a photo of myself, they got back to me instantly, asking when I could go see them. All they mentioned at the time was that they were looking for people to do “Playboy-style nudes.”

Once I got to the office to speak to them in person, we talked for hours, and the woman working there finally told me that she “basically booked girls for porn.” Then she handed me a sheet to circle the things that I was okay with doing. The only thing I circled was “solo.” She looked at it and said, “Well, the problem with this is that you won’t be able to make as much money as I proposed to you.” So I went on and circled “b/g” and “g/g,” which means boy/girl (me and a boy), and girl/girl (me and another girl). I didn’t circle anything else because I never intended to do anything else.

Every time I got interviewed by a company in the porn industry, my answers to the question “Why porn?” stayed relatively the same: “I love sex, so why not?” or “Getting paid for something I do anyway sounded like a dream job.” Etc. etc. The truth is that what draws people in is the quick money, especially for young girls coming out of high school. They may have some vague idea of what porn is like from having seen some of it, but in reality they have no clue what it actually is like to do it, until they get too deep into it.

That’s what happened to me. As embarrassed as I am to admit this now, I will humble myself and say that I was very naive when I first started in porn, and I believed all the things that people in the industry told me were true. I was so drawn to the money that I let myself believe all the lies that people fed me. I even believed my own lies that I told myself.

I am 20 years old now, and I retired from porn just a few months after I turned 19, so I didn’t do it for very long. However, it was long enough for me to finally see through all of the lies, and for the true colors of the “adult industry” to be exposed to me. Porn is not empowering, neither is it safe. But it did take quite a lot for me to face this and accept it. All of my plans to only do what I first agreed to changed after just a few months in the industry, after which I ended up jaded, disassociated, and brainwashed.

JUSTICE! 🙂 Torture porn company Kink(dot)com can’t get away with abusing performers with unsafe sex anymore!

[SF Weekly] – On Thursday, the California Occupational Safety and Health Administration issued a whopping $78,710 fine to local porn company Kink.com for workplace safety hazards. The majority of the fines were for allowing performers to work without using condoms, while a $3,710 portion of the total fine was for additional violations, including improperly placed power cords, an absence of first aid supplies, and missing health safety training materials.

The fine is one of several that OSHA has issued to local porn companies recently, and follows in the wake of several HIV scares in the industry.

And there are more fines to come! Read full details in the link below, and at the other links below that. 🙂

“I met Jersey Jaxin about two months ago through Myspace and she allowed me to come and spend time with her and listen to her story. She spoke about many things from her sexual abuse from her father to the abuse she went through in the porn.

Much of her life can be summed up in one word: ABUSE.

She made me cry during our meeting quite a bit but especially when I asked her what she did in her off time when she wasn’t doing porn and she replied, “I hold my roommate and we just cry”.

RussellsParadox, a visitor to our AntiPornographyBlog YouTube channel, asked the above question. The space to reply at YouTube was limited, so we are posting the full response here. The simple version of it is as follows:

1) If you are referring to the United States, regardless of what anyone think, most pornography is actually technically already illegal. It just isn’t prosecuted.

2) We believe that there are legal measures that can and should be put into place that can significantly reduce the harm done to individuals during the production of pornography. (And as a result of what happened during that production.) These measures can also reduce the harm done to women, children, and society in general from the existence of, consumption of, and influence of violent, degrading, and sexist pornography. Such measures would include: restricting access of Internet pornography and other types of pornography to those who are 18 and over, raising the age of participation in pornography to 21 years old, and improving the health and safety standards of pornography production in a variety of ways, including implementing mandatory condom use.

So that’s the short answer. For a longer and more detailed response with references included, please continue reading. (But be forewarned: there is very graphic, disturbing, and likely triggering content ahead!) (more…)
